In these Terms, references to “you”, “Client” shall mean the end user accessing the Website, its contents and using the Services offered through the Website and “we”, “us” and “our” shall mean Ladderup Trustee Services (“Ladderup”).

   Ladderup recognizes the need to protect the personal information that you share with us and undertakes not to disclose it to any outside party and keep it secure. However, nothing in these Terms will prevent Ladderup from making any disclosure of such information, required by law, regulation, legal process, or, by any competent authority.

2. Trademark, Copyright and Restriction

   All material on this Website, including but not limited to text, graphics, images, illustrations, audio clips, and video clips, are protected by copyrights, trademarks, and other intellectual property rights. You must not copy, reproduce, republish, upload, post, transmit or distribute such material, whether directly or indirectly, for any purpose other than personal, non-commercial use as the same will amount to a violation of the copyrights, trademarks and other intellectual property rights, and is prohibited.

3. Limitation Of Liability

   Ladderup will not be liable to you or any other party for any damages, including but not limited to direct, indirect, special, consequential, or exemplary damages, regardless of the nature or basis of the claim, resulting from any use of the website, or the contents thereof or due to the information submitted by you in relation to creation of your Estate Plan. Under no circumstances will Ladderup be responsible for any damage, loss or Injury in connection with any failure of performance, error, omission, interruption, defect, computer virus or line or system failure, even if Ladderup, or representatives thereof, are advised of the possibility of such damages, losses or expenses.

4. Indemnification

   You agree to indemnify, defend and hold harmless Ladderup, from and against any and all losses, liabilities, claims, damages, and expenses including, but not limited to, the legal fees and costs, arising out of your breach of any of the provisions of these Terms.

5. Ladderup shall create an Estate Plan based on the information shared by you. Such information will be taken on its face value and Ladderup, in no way, will be responsible to check or establish the veracity of such information.
6. It is your duty to check your Estate Plan in terms of accuracy and Ladderup will not be liable for any sort of legal claims resulting from usage of such information in your Estate Plan, under any circumstances.
7. Creation of your Estate Plan is based on our interpretation of current laws without any representation or warranties, by Ladderup, express or implied, except otherwise specified in writing.
8. The Terms shall be governed by and interpreted and construed in accordance with the laws of India. All disputes relating to the Terms & Conditions shall be settled in the Courts located in the city of Mumbai, India.
